.   Dear Mr. Chairman:

          Pursuant to an oral request of the Committee staff on June 16, 1971,
    and in accordance with subsequent discussions       between our Office and the
    Committee staff,  we are enclosing   information    on the status of the con-
    tracts between the Veterans Administration       (VA) and the Blackhawk Heating
    and Plumbing Company, Inc., for the air conditioning         of three hospitals:
    the VA hospitals  in New York City and Brooklyn,        New York, and the VA
    neuropsychiatric  hospital in Pittsburgh,      Pennsylvania.

           We did not obtain       the views of either the VA or the Blackhawk Heat-
    ing and Plumbing, Inc.,          on the enclosed information.      We plan to make
    no further   distribution        of this information     unless specifically requested,
    and then we shall make         distribution    only after your agreement has been
    obtained.

         We trust that the information                we are furnishing                    herewith   meets the
    needs of your Committee.

              The Brooklyn           contrac8;          contains          a Termination       for     Default      Clause

    which would require                    Elackhawk         to pay $300 a day in liquidation                          costs

    to the Government                for      a%1 additional               day s which resulted           from delays

    caused by Blackhawk.                      As of July            1971, the contract              was 309 days late.

    Therefore,          if   the Government                 wins the pending            appeals,       Blackhawk         may

    be liable          for   at least           $92,700          ($300 X 309 days).
