         We conducted an investigation into SBIR/STTR awards made to a small business. 1 Our investigation
         determined the PI2 violated a condition of the small business innovation research program during
         significant portions of the SBIR/STTR awards. However, because the violations occurred outside of
         the applicable statute of limitations, and due to conflicting or missing records of a third party, 3 we
         pursued this matter administratively. We notified the PI of the violations and the PI returned
         $46,3 97 to NSF. In addition, we referred the third party institution to NSF's Award Monitoring and
         Business Assistance Program due to its inadequate record keeping practices.


                         Accordingly, this case is closed.
